1. INTRODUCTION

1.1 These terms and conditions (“Terms of Use”) represent the contract between Red Balloon Therapy Private Limited (hereinafter referred to as “we”, “our”, “us” or “the Company”) and you, the user, governing your use as a visitor to https://www.redballoontherapy.com, all websites within that domain and/ or other websites (including social media sites) managed by us that reference these Terms of Use (the "Red Balloon Sites").

1.2 By using the Red Balloon Sites, you accept and agree to be bound by these Terms of Use in full. If you disagree with all or any part of these terms of use, please do not use or continue any further use of this website.

2. ACCESS TO AND USE OF THE RED BALLOON SITES

2.1 Subject to restrictions found in these Terms of Use, the Company grants you a temporary, non-exclusive, non-transferable, revocable licence to view and access content on the Red Balloon Sites available to your class of user. You shall not attempt to gain any unauthorised access to any part of the Red Balloon Sites and/or its contents.

2.2 In addition to these Terms of Use, you shall use the Red Balloon Sites in compliance with all laws, directives and regulations applicable to you. (d) to store, transmit, publish or distribute any malicious computer software, including but not limited to spyware, viruses, Trojans and worms; or

(e) for any unlawful, illegal, fraudulent, dishonest, criminal or harmful purpose or activity.

2.4 Any unauthorised use of the Red Balloon Sites shall result in the immediate termination of the temporary licence referred to in Clause 2.1 above.

3. PRIVACY POLICY

3.1 We are committed to protecting and respecting your privacy. We will comply with all applicable data protection and privacy laws. Please take the time to familiarise yourself with our Privacy Policy, which you will be deemed to have accepted by using the Red Balloon Sites.

4. INTELLECTUAL PROPERTY

5. DISCLAIMERS AND LIABILITY

5.1 While the Red Balloon Sites are intended to be accessible 24 hours a day and 7 days a week, we do not guarantee constant, uninterrupted access to the Red Balloon Sites, or that the Red Balloon Sites will always operate without faults or errors, or that the Red Balloon Sites will always remain available. 5.8 You undertake to bear full liability and to indemnify the Company, our parents, investors, subsidiaries, affiliates, and each of their respective officers, directors, and employees from any and all claims, liabilities, losses, damages, costs and/or expenses associated with any breach by you of any of the provisions in these Terms of Use.

6. VARIATION

6.1 We reserve the right to revise these Terms of Use from time to time at our sole and absolute discretion. The latest version of the Terms of Use will be made available on our website at https://www.redballoontherapy.com. It is your responsibility to keep yourself updated and aware of the latest version of these Terms of Use. If any change is unacceptable to you, you should immediately cease all further use of the Red Balloon Sites. If you continue using the Red Balloon Sites after the changes take effect, you will be deemed to have accepted the latest version of the Terms of Use.

7. USE OF COOKIES

7.1 Our Red Balloon Sites make use of “cookies”, which are small data files sent to your internet browser to store and track information about you when interact with the Red Balloon Sites. Such information is anonymised, from which individuals cannot be identified, such as:

9. GOVERNING LAW AND JURISDICTION

9.1 Use of the Red Balloon Sites and these Terms of Use are governed by and shall be construed in accordance with the laws of Singapore. You agree that the Singapore courts shall have exclusive jurisdiction over all disputes arising out of or in connection with the use of the Red Balloon Sites and these Terms of Use.
